Compliance for CalSavers Retirement Savings Program
If you received a FTB 4230 CalSavers Noncompliance Penalty Notice from FTB, CalSavers Retirement Savings Board notified us that you failed to register or comply with the requirements of the CalSavers Retirement Savings Program.
Reasons for recieving the notice would include:
- Failure to Register
- Failure to Provide Eligible Employee Information
- Failure to Facilitate Contributions for a Participating Employee
- Failure to Provide Eligible Employee Information for New Employees
- Failure to Remit Employee Contributions
Come into compliance with CalSavers Retirement Savings Program
To comply with the CalSavers Retirement Savings Program, visit the CalSavers webpage to register or complete your requirements. You will need your CalSavers access code and Federal Employer Identification Number (FEIN).
If you received our first notice, including a $250 penalty per employee, you either haven’t registered or have yet to comply with the CalSavers Retirement Savings Program requirements. If you do not comply with the requirements within 90 days from the date of the first notice, you may receive a final notice, including an additional $500 penalty per employee. An annual notice, including an additional $500 penalty per employee may be issued until compliance is reached.

How to Pay the CalSavers Noncompliance Penalty
- Send a check or money order payable to Franchise Tax Board
- Provide your Reference ID (from your FTB notice) on your payment
- Mail your payment with the Pay-By-Mail voucher included with your notice to:

How to Request a Hearing to Appeal the CalSavers Noncompliance Penalty
You may request a hearing to appeal the CalSavers Noncompliance Penalty within 90 days of your first FTB notice date. You cannot appeal your penalty after FTB issues the final notice.
