Public Records Act Request ­ Executive Order S-03-06

PURPOSE OF BULLETIN

To advise staff that Executive Order S-03-06 has been issued by the Governor of the State of California regarding guidelines relating to the Public Records Act (PRA), Government Code Section 6250 et seq.

This Public Service Bulletin has been prepared to make staff and employees aware of the accessibility of the PRA procedures and guidelines.

BACKGROUND

The California Public Records Act, Government Code section 6250 et seq., while protecting individuals' rights to privacy, provides that access to information concerning the conduct of the people's business is a fundamental and necessary right to every person in this State. "Public records" includes any writing containing information relating to the conduct of the public's business prepared, owned, used, or retained by any state or local agency regardless of physical form or characteristics.

The Governor of the State of California has issued Executive Order S-03-06, dated March 29, 2006, to all state or local agencies. It provides that public records are open to inspection at all times during the office hours of the state or local agency; and the state or local agency shall establish written guidelines for accessibility of records, which shall be posted in a conspicuous public place at the offices of these agencies and a copy of the guidelines shall be available upon request free of charges.

By April 29, 2006, each agency, department, board, commission and office of the executive branch shall:

  • Establish and/or review its written guidelines for accessibility of records.
  • Revise, as appropriate, its written guidelines for accessibility or records.
  • Post the guidelines in a conspicuous public place at all office locations.

PROCESS

Any area of the Franchise Tax Board that is available to the public shall have the Public Records Act request guidelines posted in a conspicuous place, such as the main entrance or lobby. These guidelines can be found in the Disclosure Manual located on FTB's public website

If a taxpayer makes any reference to the Public Records Act or requests public documents, other than forms, staff should:

  • Refer the requestor to the Disclosure Section at (916) 845-3226.
